Terms of service

These Terms of Service (“Terms”) govern all purchases, services, and interactions with Ink'd (“Company,” “we,” “us,” or “our”). By placing an order, submitting payment, or using our services, you agree to be bound by these Terms.

1. Products and Services

Ink'd provides custom promotional and branded products. Due to the customized nature of our offerings, all products are made to order based on customer specifications.

2. Orders and Acceptance

All orders are subject to acceptance by Ink'd. An order is not considered final until:

  • Payment is received, and

  • The customer has approved all artwork, proofs, and order details.

Once approved, orders cannot be modified, canceled, or refunded.

3. Pricing and Payment

  • All prices are listed in [USD] unless otherwise stated.

  • Payment in full is required before production begins.

  • Prices do not include applicable taxes, shipping, or handling unless explicitly stated.

  • Late payments may delay production and delivery.

4. Artwork and Proof Approval

Customers are solely responsible for verifying:

  • Accuracy of artwork, text, spelling, colors, and layout

  • Correct product selection, sizing, and quantities

Ink'd is not responsible for errors approved by the customer, including errors in customer-supplied artwork.

5. Production and Delivery

Production timelines are estimates and not guaranteed. Ink'd is not responsible for delays caused by:

  • Shipping carriers

  • Material shortages

  • Acts of God or circumstances beyond our control

Delivery dates are not guaranteed unless explicitly stated in writing.

6. No Returns or Refunds

All sales are final. Ink'd does not accept returns or exchanges, and refunds are not issued, except at our sole discretion in cases of manufacturing defects or errors caused by us.

7. Damaged or Defective Products

Claims for damaged or defective items must be submitted within 2 days of delivery and must include photographic evidence. If approved, we may:

  • Replace the affected items, or

  • Issue a credit

Variations in color, material, imprint placement, or finish that are considered industry standard are not defects.

8. Customer Cancellations

Once production has begun, cancellations are not permitted. Any costs incurred prior to cancellation approval (if granted) are the responsibility of the customer.

9. Intellectual Property

Customers represent and warrant that they own or have permission to use all artwork, logos, trademarks, and content provided. The customer agrees to indemnify and hold Ink'd harmless from any claims arising from intellectual property infringement.

10. Limitation of Liability

To the fullest extent permitted by law, Ink'd shall not be liable for:

  • Indirect, incidental, or consequential damages

  • Lost profits, business interruption, or reputational harm

Our total liability shall not exceed the amount paid for the specific order in question.

11. Indemnification

You agree to indemnify and hold harmless Ink'd, its employees, and affiliates from any claims, damages, or expenses arising from:

  • Your use of our products

  • Customer-supplied artwork or content

  • Violation of these Terms

12. Force Majeure

Ink'd shall not be liable for failure or delay in performance due to events beyond reasonable control, including natural disasters, labor disputes, supply chain disruption, or government actions. 

13. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Massachusetts, without regard to conflict of law principles.

14. Changes to Terms

Ink'd reserves the right to modify these Terms at any time. Updated Terms will be posted on our website and apply to future orders.
